General Terms and Conditions
Nifas & Familia Care – Home Healthcare and Childcare Services
Please read these Terms and Conditions carefully before requesting or using any services provided by Nifas / Familia Care. By submitting a service request or completing payment through the website, application, or customer service channels, the Client expressly and irrevocably agrees to all provisions set forth herein.
1. Definitions
Unless the context requires otherwise, the following terms shall have the meanings set forth below:

Nifas / Familia Care: The entity providing home healthcare and childcare services.

Client: Any individual who requests or pays for the service, whether for themselves or on behalf of another person.

Service Provider: Any individual licensed by the competent authorities, male or female, assigned to deliver the service to the Client.

Service: Home healthcare services for mothers after childbirth or childcare (babysitting) services, according to the subscribed package.

Platform: The website or application operated by Nifas / Familia Care.
2. Scope of Services
Nifas / Familia Care provides home healthcare services through licensed healthcare professionals, including but not limited to:

Basic postnatal healthcare for mothers.
-
Breastfeeding support and encouragement.
-
Health education and counseling.
-
Monitoring of vital signs according to the health condition.
Nifas / Familia Care also provides, upon booking babysitting packages, basic childcare services only, without any medical or nursing interventions.
The services do not include advanced medical or nursing procedures, emergency care, hospitalization, or specialized medical treatment, and shall not be considered a substitute for emergency or hospital-based healthcare services.
Nifas / Familia Care operates as an organizational and technical platform to coordinate service delivery. Services are performed by independently licensed service providers. Nifas / Familia Care is not a medical facility or treatment center. The Company reserves the right to replace the assigned service provider when necessary without affecting service quality.
3. Client Obligations
The Client agrees to:

Update contact details and address promptly upon any change.

Designate one family member as the sole point of contact with Nifas / Familia Care.

Provide a safe and healthy working environment within the home.
-
Allocate an appropriate, interruption-free space for the service provider.
-
Ensure the mother or child is fully prepared at the scheduled service time.
-
Refrain from any form of abuse or mistreatment of the service provider.

Not assign the service provider any household duties outside the agreed service scope.

Fully and accurately disclose any medical or health conditions related to the mother or child.
-
Refrain from photographing, recording, or publishing any data related to service providers without prior written consent.

Ensure that the number of children does not exceed two (2) per babysitter.
-
Ensure that the child’s age does not exceed five (5) years.
-
Ensure that the child does not require special medical care or advanced health monitoring.
-
Ensure that the child does not have conditions requiring the use of an epinephrine injection.
-
Ensure that the child has not experienced fever, repeated vomiting, or diarrhea within the past forty-eight (48) hours prior to service delivery.

Ensure that the child does not require tube feeding or any medical feeding methods.
The Client acknowledges the accuracy of all provided information and bears full responsibility for any damage or harm resulting from inaccurate disclosure or concealment of information.
4. Emergency Situations
In the event of a medical emergency, the Client authorizes the service provider to administer first aid measures only, and to immediately contact the competent authorities through the unified emergency number (911) or the Saudi Red Crescent Authority (997), as applicable. Nifas / Familia Care shall not be liable for any subsequent medical decisions or interventions.
5. Scheduling and Cancellation

Service appointments shall be scheduled according to the Platform’s approved timetable and must be utilized within a maximum period of forty-five (45) days from the date of purchase.

The Client may modify or cancel an appointment at least twenty-four (24) hours prior to the scheduled time.

Cancellations made after this period shall be considered a completed session.

If the service provider arrives at the scheduled time and is not received within fifteen (15) minutes, the session shall be canceled and charged in full.

Nifas / Familia Care shall not be liable for non-performance caused by force majeure events.
6. Fees and Payment

The full package fee, inclusive of Value Added Tax (VAT), must be paid in advance.

Payment is a prerequisite for confirming the booking and initiating the service.

Nifas / Familia Care reserves the right to temporarily suspend services in case of delayed payment.
-
No refunds shall be issued for completed sessions.
-
If the Client fails to schedule any service within forty-five (45) days from the purchase date, no refund shall be granted.
-
Refunds for unutilized sessions shall be subject to the Platform’s approved refund policy.

If the Client cancels the package prior to the first session, a cancellation request must be submitted at least one (1) business day in advance. A cancellation fee of 15% of the total package value shall be deducted.

The Client shall use lawful payment methods owned by them and bears full responsibility for any unauthorized or unlawful use.
7. Replacement of Service Provider
The Client may request a replacement of the assigned service provider once only, for justified professional reasons. A replacement shall be arranged within a maximum of three (3) business days, subject to availability.
8. Professional Liability
Nifas / Familia Care commits to providing qualified and licensed service providers. However, it shall not be liable for damages resulting from:

Incorrect or incomplete information provided by the Client.

Failure to follow health and safety instructions.
-
Requests for services outside the agreed scope.
In all cases, the total liability of Nifas / Familia Care shall not exceed the amount paid for the disputed service package.
9. Confidentiality and Privacy

Nifas / Familia Care shall maintain the confidentiality of Client data.

The Client shall not disclose or publish any information related to service providers or operational processes.

Photography, recording, or publication without written consent is strictly prohibited.

Confidentiality obligations shall remain in effect throughout the service period and for five (5) years thereafter, or until such information becomes lawfully public.
10. Termination of Service
Nifas / Familia Care reserves the right to terminate services without compensation in the following cases:

Abuse or mistreatment of service providers.
-
Violation of essential terms of these Terms and Conditions.

Provision of an unsafe working environment.
11. Client Notifications
Notifications shall be delivered via:

The approved email address,
-
SMS messages or WhatsApp.
All notifications sent through the above channels shall be deemed legally effective from the date of dispatch.
12. Governing Law
These Terms and Conditions and all related activities shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia.
13. Amendments
Nifas / Familia Care reserves the right to amend these Terms and Conditions upon notifying the Client. Continued use of the services constitutes binding acceptance of such amendments.
14. Force Majeure
Nifas / Familia Care shall not be liable for any delay, suspension, or failure in whole or in part to perform its obligations due to force majeure events beyond its reasonable control, including but not limited to natural disasters, epidemics, governmental actions, security or civil disturbances, power outages, major technical failures, telecommunications or internet disruptions, widespread cyberattacks, or failures of third-party service providers. Service obligations shall be suspended during the force majeure period and resumed once the cause ceases, without any liability for compensation.
15. Intellectual Property
All intellectual property rights related to the website, application, content, and trademarks are exclusively owned by Nifas / Familia Care. Any reproduction, use, publication, or exploitation, in whole or in part, without prior written consent is strictly prohibited and subject to legal accountability under the applicable laws of the Kingdom of Saudi Arabia.
16. Technical Updates
Nifas / Familia Care regularly updates its systems and applications and shall not be liable for any malfunctions or security breaches resulting from the Client’s failure to update the application.
17. Acceptance
Submitting a service request or making payment through the website, application, or customer service channels constitutes a legally binding, explicit, and final acceptance by the Client of these Terms and Conditions.
